2 key fobs an observation.
Having picked the 5 up from the dealers the wife shot home in her car leaving me to play at the dealers and on the way home. Picked wife up and she had got the spare fob in her bag which caused the fob I had to fail repeatedly. Once the second fob was a short distance away then all was fine.

In what way did it fail? I quite often have both fobs in my D4 when the wife is with me, and never had any issue.

I drove my D4 up to the dealer with both fobs on the same key ring, no problems. I drove the D5 home with both fobs and again no problems.
On a separate note did you get your keys in a presentation box?

It occurred when I tried to start the engine so ignition off I had been playing with various features you know just pushing buttons without RTFM seeing what's changed so I guess a good 5 mins in the cab before pressing the start button to get that warning that the fob not recognised first time I had remembered that pressing the fob against the steering colomb would effectively cure a flat fob battery so I tried that several times but no effect then I had her take the fob outside and then it seemed to work ok but that might have been a red herring as the next time it happened I pressed the unlock button on the fob after which it worked. I have still yet to repeat the issue

I had the spare key for my car in my pocket when I got into the courtesy car from the dealer (so I had 2 fobs, the correct one and a wrong one) the car complained over and over again about smartkey not found. Presumably it was seeing the wrong car as often as it was seeing the right one.
Not sure why 2 'correct' keys would cause an issue but I can confirm the car does strange things when one is inside the car and the other right outside the door. It's simultaneously attempting to agree to keyless locking at the same time as preventing you from locking the key in the car.
